Terms of Service

The terms governing your access to DizitalGini, our pay-per-lead credit settlement model, customer intellectual property guarantees, and acceptable email outreach policies.

Section 1

1. Acceptance of Terms & Eligibility

These Terms of Service (“Terms”) constitute a legally binding contract between you (“Customer,” “User,” or “You”) and DATAi2i(“DizitalGini,” “we,” “us,” or “our”), governing your access to and use of the DizitalGini platform, web application, APIs, and associated services (collectively, the “Platform”).

By creating an account, connecting a mailbox, purchasing credits, or initiating outreach campaigns, you agree to be bound by these Terms and our Privacy Policy. If you represent an organization, you represent and warrant that you have full legal authority to bind that entity to these Terms.

2. Platform Architecture & The Human-in-the-Loop Guarantee

DizitalGini is architected around specialized autonomous agents operating under strict human supervision:

  • The Prospector: Researches public corporate websites to identify relevant B2B buyer organizations matching your Ideal Customer Profile.
  • EvidenceGate™: Proprietary factual grounding layer that verifies claims before copywriting, bounding AI creativity to prevent hallucinated assertions.
  • The Copywriter: Synthesizes tailored Mini (50–75 words) and Narrative (130–180 words) outreach drafts grounded in prospect data.
  • The Closer: Dispatches approved emails and sequences through your connected mailbox.
The Human-in-the-Loop Mandate: No email is ever dispatched autonomously. Gate 1 lets you review and approve qualified companies. Gate 2 freezes the drafted copy, allowing you to edit, customize, or regenerate before giving explicit approval for send.

3. Pay-Per-Lead Pricing & Credit Terms

Unlike traditional subscription tools that charge fixed monthly fees regardless of usage, DizitalGini operates on a transparent credit-based model:

Credits Never ExpirePurchased credits remain in your account ledger indefinitely until consumed by user-approved actions.
No Monthly FeesZero recurring monthly subscription fees. You only pay for what you approve and execute.

4. Customer IP & 100% Output Ownership

You retain exclusive, unrestricted ownership of all inputs and generated outputs:

  • Your Data: All company documents, ICP parameters, prospect lists, and campaign settings belong solely to you.
  • Generated Copy: All email subjects, pitch narratives, and research dossiers produced for your campaigns are owned 100% by you. DATAi2i asserts no copyright or proprietary interest over your outreach copy.
  • No AI Model Retention: Your proprietary information is never ingested to train public, generalized foundation models.

5. Mailbox Integrations & Google / Microsoft Policy Adherence

When connecting your email infrastructure, you authorize DizitalGini strictly to execute authorized email dispatch on your behalf:

Google API Limited Use Adherence: DizitalGini strictly limits its use of data received from Google APIs to providing user-facing dispatch features (gmail.send), fully in accordance with the Google API Services User Data Policy.

Affirmative Compliance Statement:“The use of raw or derived user data received from Workspace APIs will adhere to the Google User Data Policy, including the Limited Use requirements.”

You agree that DizitalGini acts solely as a technological conduit executing your approved dispatches. You remain the Sender of Record for all communications originating from your mailbox.

Section 6

6. Acceptable Use & Anti-Spam Compliance (CAN-SPAM, GDPR)

DizitalGini is designed strictly for targeted, legitimate B2B business outreach. Customers must agree to and comply with the following mandatory standards:

  • CAN-SPAM / GDPR / PECR: All outreach emails must contain accurate header information, non-deceptive subject lines, physical business address, and clear opt-out / unsubscribe mechanisms.
  • No Spam or Harvesting: You may not use the Platform to transmit unsolicited consumer spam, malware, phishing content, or hate speech.
  • Sender Reputation: You are responsible for configuring proper DNS authentication (SPF, DKIM, DMARC) on your sending domain.
Section 7

7. Account Suspension, Revocation & Token Purge

We reserve the right to suspend or terminate accounts that violate our Anti-Spam policies or engage in abusive sending patterns.

Upon account termination or mailbox disconnection, all stored OAuth tokens and credentials are permanently purged from database vaults immediately.

8. Warranties, Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAI2I DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL DATAI2I BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR EMAIL DELIVERABILITY BLOCKS IMPOSED BY THIRD-PARTY MAIL PROVIDERS.

Section 9

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Visakhapatnam, Andhra Pradesh, India.
